E-cigarettes, registration form for retailers via cross-border distance sales

Without confirmation of registration from the Danish Safety Technology Authority, you must not supply a relevant product to a consumer via a cross-border distance sale.

The Danish Safety Technology Authority will maintain the short average time of 14 days for processing the registration.

In case of rejection

If the Danish Safety Technology Authority decides to reject your registration, you will receive a reasoned notification. You cannot appeal this decision to other authorities.

The same requirements apply as for EU citizens and businesses.

Marketing is making electronic cigarettes and refill containers with or without nicotine available to consumers with or without payment. In case of cross-border distance sales, the products are considered to have been marketed in the country where the consumer is located. This appears in section 2, no. 10 in Act no. 1876 of 20 September 2021 on electronic cigarettes etc.

The Danish Safety Technology Authority would like to point out, that when distance selling products towards Denmark your website or app is required to have an effective age control system. The age control system must be an IT-system, which unambiguously verifies the consumers age to be compliant with the required age limit.

According to section 2, no. 12 and section 15 no. 3 in Consolidated Act No. 1876 of 20 September 2021 on E-cigarettes etc., as amended by Act No. 99 of 25 January 2022 and Act No. 738 of 13 June 2023 and act no. 651 of 11th of June 2024.

When implementing the verification solution, there is a freedom of method. An effective electronical age verification could for example be done by user creation with passport or another valid identity document or by using a national EID-solution, for example MITID. As a retail dealer, it is your responsibility to document and account the effectivity of your age control system. If you don’t use an effective age control system, you risk being given a fine.

The Danish Safety Technology Authority will regularly publish and update a list of registered retailers on its website. In case of changes of the registered information, the registered party is obliged to inform the Danish Safety Technology Authority hereof.
