Purpose:
The Danish Patent and Trademark Office is the Danish authority that issues and registers patents, utility models, trademarks and designs (“IP-rights”). Your personal data will therefore be processed by the Danish Patent and Trademark Office when you submit a power of attorney form to us relating to one of these four IP-rights.
Legal basis:
The legal basis for processing your personal data is found in the Danish Patents Act (Consolidate Act no. 90 of January 29, 2019), the Danish Utility Models Act (Consolidate Act no. 91 of January 29, 2019, the Danish Trade Marks Act (Consolidate Act no. 88 of January 29, 2019) and the Danish Designs Act (Consolidate Act no. 89 of January 29, 2019)
The personal data processed is general personal data, including your name and contact information as address, telephone number, email. In the case of sole proprietorship, personal data in the form of CVR number (Company Registration number) or VAT number be processed.
We will process your CPR number (Civil Personal Registration number), if the form is signed using a personal NemID.
We can disclose your personal data to the following recipients:
Other public authorities, such as The Board of Appeal of Patents and Trademarks, the Ministry of Industry, Business and Financial Affairs, the Danish Tax Authority (SKAT), the police, etc.
Data processors to the extent necessary in order to maintain our case handling systems.
Users of our electronic databases containing applications and registered rights, which we are required to make publicly available, including private search databases of intellectual property rights. We only disclose data which we are required to announce and keep publicly available by law.
We can disclose your personal data to international organizations and IP Offices of other countries within the area of international cooperation and agreements. We primarily disclose data which we are required to announce and keep publicly available.
We are processing the personal data submitted to us.
If we receive an enquiry from a third party in your case, containing personal data related to you, we will, as a starting point, forward a copy of the enquiry to you.
We are storing your personal data in accordance with applicable law governing our work, including the Danish Public Administration Act (forvaltningsloven), the The Danish Access to Public Administration Files Act (offentlighedsloven), the Danish Archives Act (arkivloven) and our international obligations. The storage period will thus be determined by this and by the continuous purpose of the storage.
If personal information about you has been submitted, you have the right to withdraw your consent at any time. This can be done by contacting us.
If you choose to withdraw your consent, it does not affect the lawfulness of our processing of your personal data based on your previously given consent and up to the time of the withdrawal. Therefore, if you withdraw your consent, it will only take effect from this time.
Pursuant to the General Data Protection Regulation, you have several rights in relation to our processing of data concerning you. If you wish to exercise your rights, you must contact us.
Right of access
You have the right to obtain access to the data we process concerning you, together with a number of other data.
Right to rectification (correction)
You have the right to have incorrect data concerning you rectified.
Right to erasure
In special cases, you have the right to have data concerning you erased before the time of our ordinary general erasure.
Right to restriction of processing
In certain cases, you have the right to restrict the extent to which we process your personal data. If you have the right to restrict processing, we will henceforth only process information with your consent – with the exception of storage – or if a legal claim can be established, exercised or defended, or to protect a person or important public interests.
Right to object
In certain cases, you have the right to object to our processing of your personal data.
Right to transmit data (data portability)
In certain cases, you are entitled to receive your personal data in a structured, commonly used and machine-readable format, and to have this personal data transmitted from one data controller to another without hindrance.
