We process your personal data for the following purposes:

The purpose of processing your personal data is to make decisions in specific matters regarding lawyers’ practising of law.

The basis in law for our processing of your personal data ensues from: 

The Department of Civil Affairs’ legal basis for processing your personal data is Article 6(1)(e) and Article 9(2)(f) of the General Data Protection Regulation, Part 12 on admission to practise law, Part 13 on lawyers’ right of audience before the courts and Part 14 on revocation of a licence to practise law as well as sections 147e(2), 147f(2), 260 and 267b to 267d of the Danish Administration of Jus-tice Act (retsplejeloven).

We process the following categories of personal data about you:  

General personal data, sensitive personal data and details of criminal offences.

We disclose your personal data or make it available to the following recipients: 

• The Danish National Archives (Rigsarkivet) for archiving purposes under the provisions of the Danish Public Records Act (arkivloven).

• The Council of the Danish Bar and Law Society (Advokatrådet).

• The Ministry of Justice´s course committee (Justitsministeriets kursusudvalg) in cases of dispensation from section 119(2), no. 5, of the Danish Administration of Justice Act.

• The Danish Agency for Science and Higher Education (Styrelsen for Forskning og Uddannelse) in matters falling within section 135a of the Administration of Justice Act and Directive 2005/36/EC on the recognition of professional qualifications.

• In certain circumstances and subject to your consent, the police (the Central Criminal Register (Det Centrale Kriminalregister)) and the Danish tax authorities.

• The Legal Adviser to the Danish Government (Kammeradvokaten) in connection with the appeal of administrative decisions to the courts or the institution of legal proceedings.

The personal data are provided by the applicant.

Vi storage your personal data for 20 years after the end of the file period in which your case was closed.

If personal information about you has been submitted, you have the right to withdraw your consent at any time. This can be done by contacting us.

If you choose to withdraw your consent, it does not affect the lawfulness of our processing of your personal data based on your previously given consent and up to the time of the withdrawal. Therefore, if you withdraw your consent, it will only take effect from this time.

Pursuant to the General Data Protection Regulation, you have several rights in relation to our processing of data concerning you. If you wish to exercise your rights, you must contact us.  

Right of access 

• You have the right to obtain access to the data we process concerning you, together with a number of other data.  

 Right to rectification (correction) 

• You have the right to have incorrect data concerning you rectified.  

 Right to erasure 

• In special cases, you have the right to have data concerning you erased before the time of our ordinary general erasure.  

 Right to restriction of processing 

• In certain cases, you have the right to restrict the extent to which we process your personal data. If you have the right to restrict processing, we will henceforth only process information with your consent – with the exception of storage – or if a legal claim can be established, exercised or defended, or to protect a person or important public interests.   

Right to object 

• In certain cases, you have the right to object to our processing of your personal data.  

 Right to transmit data (data portability)  

• In certain cases, you are entitled to receive your personal data in a structured, commonly used and machine-readable format, and to have this personal data transmitted from one data controller to another without hindrance.
